Welcome to www.houseofbimbi.com (Site) the place to purchase elevated essentials for family and home (Products).

The Site is operated by House of Bimbi Pty Ltd (ABN 63 660 172 798) (House of Bimbi or we or us).

2. What these Terms are about


Both you and House of Bimbi agree to follow these Terms and our Privacy Policy when you use our Site or you purchase any Products from the Site. We may from time to time add specific additional Terms elsewhere on the Site for specific promotions or Products. Those are also included as part of the Terms.

We may change the Terms from time to time by updating them on the Site. The Terms that are current at the time we accept an order from you to buy a Product (Order) will apply to that Order.

3. Using the Site


You agree to use of the Site in accordance with these Terms and the law.

If you are under 18 years of age, then you must obtain your parent or guardian’s consent before accessing and using the Site.

When asked, you only ever provide your personal details and won't impersonate another person when using the Site.

You can only use the Site to browse and purchase Products for personal use. The Site is not here for use by people who want to misuse it, tamper with it, commit fraud, collect personal information, harass or threaten others, use our intellectual property, or take our data.

The Site may contain links to other sites not run by us. Those links are for your convenience and we don't monitor or take any responsibility for their content or privacy practices.

4. Orders


An order for Products (Order) can be placed by completing and submitting an order form using the Site. When you place an Order, you are making an offer to purchase the Products at the price on the Site including any delivery fee and associated charges and taxes.

Generally once an Order has been placed we are unable to make any changes, additions or amendments to it. However, if you only just placed the Order and have made a mistake, get in contact with us as soon as possible and hopefully we can fix it if it’s not too late.

You have to provide us with current, complete and accurate details when placing an Order.

Sometimes we have to refuse Orders. This can be for a variety of reasons including because the Product has become unavailable, we are out of stock, there was an error in our pricing, or we were unable to process your payment.

Once you have placed an Order, you will receive a message from us confirming your Order has been received. Acceptance of your Order only takes place when you receive a message from us confirming shipment. This is then a contract for the supply of the Products to you which is governed by these Terms and the law applying in Queensland, Australia.

5. Price and Payment


Prices of Products and associated fees and charges displayed on the Site are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST).

We regularly update our Prices to reflect the best price we are able to give you and so they may change without any notice to you.

We accept the following payment methods: AMEX, VISA, Mastercard, Google Pay, Apple Pay, Shopit, Klarna, Afterpay. These payment providers have their own terms and conditions and privacy policies that you need to make yourself aware of and which we rely on you to follow.

You will be issued a tax invoice once payment for your Order has been processed in full.

6. Delivery


We expect to deliver all Orders to the delivery address you provide (Delivery Address) within 14 working days of our shipment confirmation to you (Delivery Date).

Title and risk in a Product pass to you when the Product is delivered to the Delivery Address (whether received by a person at the Delivery Address or left at the Delivery Address under an 'authority to leave') or when collected by you or another person under your authority from a collection point of our delivery partner, whichever occurs first.

If an Order has not been delivered to the Delivery Address by the Delivery Date, you may cancel the Order by lodging a late delivery claim here customerservice@houseofbimbi.com. An Order is considered delivered on the date that our delivery partner first attends the Delivery Address, even though the Order may then be re-routed to a collection point if you are not there.

Once we have received your late delivery claim, we will notify you whether we have accepted your claim within 5 working days. We may reject your claim if we have evidence of delivery or if you have provided the wrong Delivery Address. If we accept your claim, we will issue to you a store credit for an amount equal to the price paid by you for the Products.

7. Product Information


House of Bimbi makes every effort to ensure a Product is accurately described on the Site. However, we do rely on information provided by the manufacturer or distributor of that Product. Also sometimes there may be some minor differences between a delivered Product and the appearance of that Product on the Site due to limitations associated with virtual presentation of a Product (for example, size or colour).

To the extent permitted by law, we are not responsible for these minor differences in appearance or for any inaccuracies or errors based on information provided by the manufacturers or distributors.

8. Faulty or defective Products


You are entitled to the benefit of consumer guarantees in respect of products purchased from House of Bimbi under the Australian Consumer Law. These consumer guarantees cannot be excluded, limited or modified and are in addition to any manufacturer warranties or extended warranties purchased or provided to you.

We aim to provide you with Products of the highest standard and quality. If you suspect that a Product you have received is faulty or defective, please promptly contact our team at customerservice@houseofbimbi.com to make a claim.

To make a claim you will need to provide us with all information we reasonably require to process your claim, including details and images of the fault or defect.

If a Product has a minor fault or defect, we will provide a replacement Product or, where this is not possible, refund the price of the Product to your original payment method.

If the Product has a major fault or defect, you may choose whether you want us to replace the Product or refund the price of the Product to your original payment method. A Product is only considered to have a major defect where the Product:

  • has a problem that would have stopped someone from buying the Product if they had known about it;
  • is unsafe;
  • is significantly different from the sample or description; or
  • does not do what it said it would and cannot be easily fixed.

Where a Product is damaged or is of unacceptable quality due to fair wear and tear, misuse, failure to use in accordance with manufacturer instructions, abnormal use or failure to take reasonable care, the Australian Consumer Law and manufacturer warranty may not apply, and in those circumstances House of Bimbi will not provide a refund or replacement.

9. Returns policy


In addition to your rights under clause 8, you may return an eligible Product to us within 14 days of the Date of Delivery of the Product in exchange for a store credit provided the returned Product is:

  • new, unused and in a saleable condition with the original tags still attached or still inside its original packaging; and
  • is not one of the following items excluded from return due to safety standards, hygiene standards or laws preventing resale: cots, bassinets, mattresses, play mats, furniture, intimates, breast pumps & accessories, prams & strollers, car seats, bulky items and capsules.

A shipping fee of $9.99 is payable for all returns unless the return is due to fault or defect. If you lodge a return, you authorise us to charge this amount using your original payment method for the Product.

Once we have received your returned Products, we will notify you whether we have accepted your return within 5 working days. Upon acceptance of your return, we will issue to you a store credit for an amount equal to the price paid by you for the returned Product.

Nothing in clause 8 or 9 is intended to limit or exclude any rights and remedies you may have as a consumer under the Australian Consumer Law, including in respect of faulty products.

10. Store credit and Gift Vouchers


A store credit and gift vouchers are valid for 3 years from the date of its issue after which the store credit and gift vouchers are void and not available for use. Store credits and gift vouchers are non-transferrable. Store credit and gift vouchers do not accrue interest, nor can it be redeemed or refunded for cash at any time.

11. Ratings and Reviews


We love people providing ratings or reviews, but we also want to make sure all reviews on our Site have integrity. So, if you are going to submit a rating or review make sure that before you do:

  • you have actually purchased and used the Product, and the rating or review reflects your honest opinions, findings, beliefs and experiences in relation to that Product;
  • you have not received any payment or other benefit for giving the rating or review; and
  • you have no affiliation with the manufacturer or provider of that Product, or any competitor of the manufacturer or provider of that Product.

12. Privacy


House of Bimbi will comply with the Privacy Act 1988 (Cth) and its Privacy Policy

13. General


If House of Bimbi is prevented from or delayed in performing an obligation by an event beyond its reasonable control, which occurs without the fault or negligence of the House of Bimbi (Force Majeure) and promptly acts to mitigate or remove the Force Majeure and its effect, then the obligation is suspended during, but for no longer than, the period the Force Majeure continues and any further period that is reasonable in the circumstances.

These Terms are governed by the law applying in Queensland, Australia and each party irrevocably submits to the non-exclusive jurisdiction of the courts of Queensland.

To the extent a provision of these Terms is or becomes illegal, void or unenforceable, that provision (or the relevant part) will be severed, and the remainder of these Terms has full force and effect.

These Terms constitute the entire agreement and understanding of the parties and supersede any prior written agreement or understanding of the parties and except where they cannot be excluded under the Australian Consumer Law, all implied terms, warranties and guarantees, whether statutory or otherwise are excluded (whether written or otherwise).

We are not liable for any indirect or consequential loss arising from or connected to these Terms including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind.
